GDLSK partner Joseph Spraragen was quoted in a Newsweek article examining how companies are handling the estimated $166 billion in tariff refunds now being returned to importers after the Supreme Court’s decision striking down the majority of the administration’s IEEPA tariffs.
Spraragen addressed how much of the total may go unclaimed, telling Newsweek, “I would anticipate that 10-15 percent of the duties collected will not be refunded.” He pointed to ongoing litigation over finally liquidated entries, as well as importers who are owed refunds but have not yet filed cases with the U.S. Court of International Trade or administrative claims with U.S. Customs and Border Protection (CBP) through the CAPE portal.
