Following the U.S. Supreme Court’s decision striking down President Trump’s blanket tariffs, GDLSK partner Erik Smithweiss was quoted in Yahoo Finance, and partner Joseph Spraragen was mentioned in Reuters in articles examining the significant uncertainty facing companies that have already paid duties and are now considering whether and how to pursue refunds.
As Smithweiss stated in Yahoo Finance, “The notion that American taxpayers have to now litigate to get back money that the government illegally collected is unfortunate,” noting that litigation in the U.S. Court of International Trade currently appears to be the only mechanism to compel refunds. The article estimates that as much as $175 billion in tariff revenue could be subject to refund claims.
