GDLSK partner Joseph Spraragen was recently quoted in a Reuters article examining the implications of the Supreme Court’s oral arguments on the use of the International Emergency Economic Powers Act (IEEPA) by the Trump administration to impose sweeping global tariffs.
In the article, Spraragen commented on the potential challenges that could follow a ruling against the administration, particularly regarding the question of refunds for duties already paid. “A ruling that includes no provisions for refunds would result in major new court challenges from companies that paid duties,” he said.
Spraragen further noted that while the most expedient method of issuing refunds would be through U.S. Customs and Border Protection’s Automated Customs Environment (ACE) processing system, practical implementation could take up to a year, and the administration won’t necessarily be eager to comply.
