GDLSK Secures Victories in Two Major Trade Cases

0% AD Rate Secured for Chinese Xanthan Gum Exporters
In the final results of the U.S. Department of Commerce’s 2022–2023 administrative review of xanthan gum from the People’s Republic of China, GDLSK successfully represented Chinese producers and exporters, obtaining a 0% dumping margin for one of the firm’s clients. This result is highly unusual means that the client will face no antidumping duties on its U.S. sales during the period of review. By avoiding any adverse findings or the application of punitive duties, this result eliminates liabilities for past imports and allows the client to remain competitive in the U.S. market.

No Dumping Affirmed by Court in Indian Shelving Case
In another decisive win, the U.S. Court of International Trade (CIT) affirmed the Department of Commerce’s negative final determination in the less-than-fair-value investigation of boltless steel shelving units prepackaged for sale from India.

Representing Triune Technofab Private Limited, GDLSK successfully defended Commerce’s finding that the Indian producer had not engaged in dumping—a result that precludes the imposition of any AD duties on imports of the shelving units. The CIT’s decision recognized that Commerce’s use of publicly available financial data and the exercise of discretion in evaluating surrogate values and submission deadlines were proper. The court’s decision validates the legal and procedural strategies advanced by GDLSK throughout the investigation and subsequent litigation.
