The Consumer Product Safety Commission (CPSC) proscribes standards applicable for over 15,000 types of consumer products, from apparel to electrical articles to toys, which are imported or sold in the United States. Many state legislatures have also enacted product safety guidelines which create additional regulatory requirements. In addition to monetary fines and penalties, non-compliant merchandise may be seized, destroyed, and/or excluded from the United States. Products found to be hazardous after distribution can be subject to mandatory recalls.
The firm has assisted clients with regard product safety on both the federal and state levels. Our attorneys routinely liaise with the regulatory officials who oversee product safety issues. We regularly advise clients regarding compliance with the “small parts” requirements and other toy safety regulations under the Federal Hazardous Substances Act as well as the Federal and State restrictions regarding drawstrings on children’s clothing, the Flammable Fabrics Act, the restrictions regarding the use of lead in consumer products and the Poison Prevention Packaging Act administered by the CPSC. We have counseled our clients in connection with recalls of various types of consumer products.
